TL;DR
Photograph everything immediately, call your insurer within 24–48 hours, get an FIR or Non-Traceable Certificate, and do not move the car to an unauthorised garage. If the insurer rejects your valid claim, go to the Insurance Ombudsman or consumer forum — courts are ruling in favour of vehicle owners in 2026. If the person who hit your car has a VahanTag, they could have scanned their own sticker to alert you on the spot, avoiding the whole mess.
You return to your car in a parking lot and find a fresh dent or a deep scratch on the door panel. No note, no witness. This happens thousands of times a day across India. Knowing the exact steps to follow — and the insurance process — determines whether you get paid or spend weeks in frustration.
This guide covers the insurance aftermath. For finding who did it, see our separate article on what to do when your parked car is scratched.
Step 1 — Document Everything Immediately
Before you move the car or touch anything:
- Photograph the damage from multiple angles in natural light
- Photograph the surrounding area — other parked cars, CCTV camera positions, entry/exit points
- Note the exact time, date, and location (GPS pin if possible)
- If there are any witnesses or security guards, get their contact details
- Check if the other vehicle is still present — photograph its number plate
This documentation is the foundation of your claim. Without it, your insurer can and will dispute the cause, date, and severity of damage.
Step 2 — Inform Your Insurer Within 24–48 Hours
Most motor insurance policies require you to report a claim within 24 to 48 hours of the incident. Missing this window gives insurers a technical ground to reject the claim. Call your insurer's helpline or use their app immediately.
When reporting, provide:
- Your policy number
- Date, time, and location of the incident
- Description of the damage
- Details of the at-fault vehicle (if known)
The insurer will assign a claim number and a surveyor. Do not send the car for repair before the surveyor inspects it — doing so can void your claim entirely.
Step 3 — FIR or Non-Traceable Certificate?
This is where many people get confused. Here's the practical rule:
- At-fault driver identified: File an FIR at the nearest police station. Include the other vehicle's number plate and all evidence. This enables third-party liability if the other driver has insurance.
- At-fault driver unknown (hit-and-run): File a complaint at the nearest police station and request a Non-Traceable Certificate (NTC) or a written acknowledgement of your complaint. Most insurers accept this in place of an FIR for minor damage.
- Damage below your deductible: If repair cost is likely lower than your excess/deductible, skip the insurance claim and pay out of pocket to avoid a No Claim Bonus (NCB) loss.
Step 4 — Own Damage Claim vs Third-Party Claim
Understanding which type of claim applies saves time:
- Own Damage (OD) claim: Under your comprehensive policy, covers repair of your vehicle regardless of who caused the damage. You pay the deductible; insurer pays the rest. Your NCB resets.
- Third-Party (TP) claim: If the at-fault driver is identified and has valid insurance, you can claim against their third-party policy. This does not affect your NCB. However, it requires their insurer's cooperation and can be slower.
For parking lot scratches where the at-fault driver is anonymous, an Own Damage claim is typically the fastest route.
What Insurers Are Not Allowed to Do (2026 Consumer Forum Rulings)
Indian consumer forums and the Insurance Ombudsman have become increasingly pro-consumer in 2026. Key rulings relevant to parking damage claims:
- Insurers cannot reject a claim solely because the damage was in a private parking lot
- An insurer cannot deny payment citing the vehicle's age if the policy was validly in force at the time of damage
- Rejecting a claim without proper survey or giving vague reasons has been repeatedly held as deficiency of service, with consumer forums awarding compensation plus mental harassment damages
- If your insurer demands documents not specified in the policy, you are not obligated to provide them
How to Fight an Unjust Rejection
- Insurance Ombudsman: Free, fast (decisions within 30 days for claims up to ₹50 lakh), and binding on the insurer. Find your regional ombudsman at irdai.gov.in.
- District Consumer Forum: File under the Consumer Protection Act 2019. No court fees for claims up to ₹50 lakh. Consumer forums in 2026 regularly award the claim amount plus compensation for harassment.
- IRDAI Grievance Portal: Bima Bharosa portal at bimabharosa.irdai.gov.in for online complaint registration.
How VahanTag Changes the Whole Equation
The entire insurance and FIR process is avoidable if the person who scratched your car had a way to contact you on the spot. With VahanTag on your car:
- A guilty driver who accidentally scratched your vehicle can scan your QR, send you a message, and take responsibility — before fleeing becomes the default choice
- You receive their message via WhatsApp or SMS with the reason marked as "vehicle issue"
- You have a digital record of the contact — useful even for insurance purposes
- No confrontation needed — the scan creates a private, anonymous channel that removes the awkward face-to-face element
Similarly, if you accidentally scratched someone else's car and they have a VahanTag, you can scan it, alert them, and resolve it without involving police. This is how civilised parking works.
