Terms of Service

1. Acceptance of Terms

By accessing and using VahanTag's QR-based vehicle contact solution — including our website (vahantag.me), mobile web app, QR scan pages, and any related services — you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.

These terms apply to all users: registered vehicle owners, purchasers, and third-party QR code scanners who interact with VahanTag stickers.

2. Eligibility

You must be at least 18 years of age to create an account, purchase a sticker, or activate a VahanTag. By using this service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

3. Service Description

VahanTag provides a QR code sticker service that allows vehicle owners to be contacted without revealing their personal phone number. When someone scans your VahanTag QR code, you receive a WhatsApp message or SMS notification. VahanTag also provides an SOS emergency alert feature that notifies designated emergency contacts.

During sticker activation, you may optionally designate one emergency contact as "public". When this option is enabled, that contact's name and mobile number will be displayed to the anonymous third party who triggers an Emergency SOS scan, so they can call that person directly. Enabling this feature is entirely voluntary and requires the contact's prior consent.

Important: VahanTag is not an emergency service. It does not replace 112, police, fire, or ambulance services. We do not guarantee delivery of notifications, and there may be delays due to network conditions, device settings, or third-party service outages. In an emergency, always call 112 or your local emergency services first.

4. Partner & Distributor Programs

VahanTag offers two separate commercial programs for businesses and individuals who wish to sell or distribute VahanTag products:

4.1 Partner Program

The Partner Program allows eligible businesses to sell VahanTag products and earn commissions. Partners do not purchase inventory. Key terms:

• Participation is subject to application and approval by VahanTag.
• Commission rates and payment terms are communicated during onboarding and may be revised by VahanTag with reasonable notice.
• Partners must represent VahanTag accurately and may not make claims beyond what VahanTag officially states.
• VahanTag retains ownership of all customer relationships and data.
• VahanTag may terminate a partner relationship at its discretion with 30 days written notice.

4.2 Distributor Program

The Distributor Program allows approved businesses to purchase VahanTag stickers in bulk at wholesale pricing for resale. Key terms:

• Minimum order quantity is 1,000 tags per order.
• All distributor orders require 100% advance payment before dispatch.
• Distributors may set their own resale pricing up to the maximum retail price (MRP) set by VahanTag.
• Distributor orders are non-returnable. Replacements are provided only for products damaged during delivery or incorrectly shipped by VahanTag.
• Distributors must sell exclusively under the VahanTag brand. White-labelling or rebranding is not permitted.
• All activated end customers remain customers of VahanTag. The distributor's role is limited to purchasing and reselling inventory.
• VahanTag provides free shipping from its warehouse to the distributor's delivery address. Onward delivery to the distributor's customers is the distributor's responsibility.

Specific commercial terms for both programs are confirmed in writing during the onboarding process. In the event of any conflict between these general Terms and a written program agreement, the written agreement shall prevail.

5. User Responsibilities

As a VahanTag user, you agree to:

• Provide accurate and truthful information during registration and activation
• Use the service only for legitimate vehicle contact purposes
• Not misuse the service for spam, harassment, or illegal activities
• Keep your contact information up to date
• Obtain consent from individuals before adding them as emergency contacts. During activation, you confirm that each contact has been informed and has agreed to receive emergency alerts from VahanTag.
• Obtain explicit consent from any contact you designate as "public" — they must be aware their name and mobile number will be visible to anonymous scanners during an Emergency SOS
• Respond appropriately to legitimate contact attempts

6. Prohibited Uses

You may not use VahanTag for:

• Any unlawful, harmful, or fraudulent purposes
• Harassment, threats, or abuse of other users
• Commercial solicitation or spam
• Impersonation of others
• Submitting false alerts or fake SOS reports
• Designating a contact as "public" without their knowledge or consent, or entering a third party's number as a public contact without authorisation
• Circumventing the privacy protection features
• Reverse engineering, scraping, or attempting to extract data from our service

7. Electronic Communication Consent

By using VahanTag, you consent to receive electronic communications from us via WhatsApp, SMS, and email. These communications include: OTP codes, alert notifications, SOS alerts, order updates, delivery notifications, and service announcements. You agree that these electronic communications satisfy any legal requirement that such communications be in writing.

8. Payment & Pricing

VahanTag stickers are priced at ₹499 per sticker + 18% GST (inclusive of CGST 9% + SGST 9% for intra-state, or IGST 18% for inter-state orders). Delivery is free. All payments are processed securely through Razorpay. We do not store your payment card or UPI details.

"Lifetime access" means the sticker and its digital services (alert notifications, dashboard access) will remain active for as long as you own the vehicle the tag was activated for. VahanTag is tied to the vehicle owner — not the vehicle itself — so if you sell or transfer ownership of your vehicle, the tag becomes inactive and the new owner must purchase a new VahanTag.

In the unlikely event that VahanTag permanently ceases operations as a service, all activated tags will continue to remain functional for a period of 3 years from the date of official service discontinuation. We will provide at least 90 days advance written notice to all registered users before any such discontinuation.

9. Cancellation Policy

Orders may be cancelled within 2 days of placing the order, provided the order has not yet been shipped. Once an order status changes to "Shipped", cancellations are no longer accepted. To cancel, use the cancellation option in your dashboard or contact [email protected].

Upon successful cancellation, a full refund will be initiated to your original payment method within 5–7 business days.

10. Return & Refund Policy

Returns are accepted within 7 days of the delivery date, subject to the following conditions:

• Only non-activated stickers are eligible for return. Once a sticker is activated (linked to a vehicle), it cannot be returned.
• A return processing fee of ₹100 + GST per sticker will be deducted from the refund amount.
• Stickers must be in their original, undamaged condition.
• To initiate a return, use the return option in your order details page.
• Refunds are processed within 7–10 business days after we receive and verify the returned sticker(s).

11. Shipping & Delivery

Orders are typically dispatched within 1–2 business days and delivered within 4–10 business days from the date of dispatch, depending on your location. Delivery timelines are estimates and not guaranteed. We are not liable for delays caused by courier partners, incorrect addresses, or force majeure events.

12. Intellectual Property

All VahanTag trademarks, logos, brand elements, website content, and service marks are the property of VahanTag Technologies. You are not permitted to use, reproduce, or distribute them without our prior written consent.

13. Service Limitations & Disclaimer of Warranties

VahanTag is provided on an "as-is" and "as-available" basis. We make no warranties or representations, express or implied, including but not limited to:

• Uninterrupted or error-free service
• Guaranteed delivery of all notifications within a specific timeframe
• Compatibility with all devices, browsers, or network conditions
• Protection against all forms of misuse by third parties
• Accuracy of GPS location data captured during scans

To the maximum extent permitted by applicable law, we disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by applicable law, VahanTag Technologies, its owner, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, data, or goodwill; service interruption; personal injury; or property damage arising out of or related to your use of VahanTag.

In no event shall our total liability to you exceed the amount you paid for the VahanTag service (i.e., the purchase price of your sticker(s) including GST).

15. Indemnification

You agree to indemnify, defend, and hold harmless VahanTag Technologies and its owner from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:

• Your violation of these Terms
• Your misuse of the service (including false alerts or SOS abuse)
• Your violation of any third-party rights (including adding emergency contacts without their consent)
• Any content or information you provide through the service

16. Termination

We reserve the right to suspend or terminate your access to VahanTag, without prior notice, if you violate these terms or engage in any prohibited activities. In such cases, no refund will be provided. We may also deactivate stickers linked to accounts found in violation.

17. Force Majeure

VahanTag shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions, internet or telecom outages, power failures, strikes, or acts of third-party service providers (WhatsApp, SMS gateways, courier services, payment processors).

18. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms shall be:

1. First attempted to be resolved amicably through direct discussion within 30 days of written notice.
2. If unresolved, submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed mutually. The seat of arbitration shall be Pune, Maharashtra.
3. The courts of Pune, Maharashtra shall have exclusive jurisdiction for any matters not subject to arbitration.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

20. Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will notify registered users via WhatsApp/SMS and update the "Last updated" date. Continued use of VahanTag after changes constitutes acceptance of the revised terms.
